1. Acceptance of Terms
By accessing or using the website thevobot.in and any services offered by The VoBot Developers ("VoBot," "we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to all of these Terms, you must not use our website or services. Your continued use of the platform constitutes acceptance of these Terms as amended from time to time.
2. Definitions
- VoBot / Company: The VoBot Developers, a digital services company registered and operating in India.
- User / Client: Any individual or entity that accesses, browses, or uses the VoBot platform or purchases services.
- Services: All digital products, development services, consulting, design, hosting, and related offerings listed on the VoBot platform.
- Platform: The website located at thevobot.in, including all subdomains, web applications, and associated digital properties.
- Order: A confirmed request for services placed through the platform, whether paid in full or via partial payment.
3. Description of Services
The VoBot Developers operates a digital services marketplace that offers website development, mobile app development, UI/UX design, cloud & DevOps solutions, AI/ML integrations, e-commerce solutions, maintenance & support packages, and custom software development. Service descriptions, pricing, and delivery timelines are indicative and may vary based on project complexity, scope, and client requirements. All services are delivered digitally unless otherwise agreed in writing.
4. User Accounts & Authentication
To place orders and access certain features, you must create an account on our platform. Account registration and authentication are handled through phone number OTP verification powered by Firebase Authentication. By registering, you agree to:
- Provide a valid Indian mobile phone number that you own or are authorized to use.
- Keep your account credentials confidential and not share your OTP or access with third parties.
- Accept responsibility for all activities conducted through your account.
- Notify us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms, engage in fraudulent activity, or remain inactive for an extended period.
5. Ordering & Pricing
All prices on the VoBot platform are listed in Indian Rupees (INR) and are exclusive of applicable taxes (GST) unless stated otherwise. Pricing displayed on service pages represents starting prices; final pricing is determined after scope discussion and is provided via a formal quotation.
- Order Placement: Orders are placed through the platform after selecting a service, discussing requirements, and receiving a quotation.
- Partial Payments: VoBot supports partial payment options. You may pay a portion of the total amount upfront to initiate work, with the remaining balance due at agreed milestones or upon delivery.
- Price Validity: Quotations are valid for 30 days from the date of issue unless otherwise specified.
- Additional Charges: Any scope changes, additional features, or revisions beyond the agreed scope may incur additional charges, which will be communicated and agreed upon before implementation.
6. Intellectual Property Rights
Unless explicitly stated in a separate written agreement:
- Client Deliverables: Upon full payment of the agreed fee, intellectual property rights in the final deliverables created specifically for the client are transferred to the client.
- VoBot IP: All pre-existing intellectual property, frameworks, tools, libraries, templates, and methodologies owned by VoBot remain our exclusive property. We grant clients a non-exclusive, non-transferable license to use such components as part of the delivered solution.
- Third-Party Components: Any open-source or third-party components used in deliverables are subject to their respective licenses.
- Portfolio Rights: VoBot retains the right to showcase completed projects in our portfolio unless the client requests otherwise in writing.
7. Delivery Timelines & Revisions
Estimated delivery timelines are communicated at the time of order confirmation and depend on the nature and complexity of the service. While we strive to meet all stated deadlines:
- Timelines are estimates and not guaranteed commitments unless specified in a formal Service Level Agreement (SLA).
- Delays caused by the client (late content delivery, delayed feedback, scope changes) may extend the timeline proportionally.
- Revisions: Each service includes a specified number of revision rounds (typically 2–3). Revisions must be requested within 7 days of delivery. Additional revisions beyond the included rounds are billed at our standard hourly rate.
- Acceptance: If no feedback is received within 14 days of delivery, the deliverables are considered accepted.
8. Limitation of Liability
To the maximum extent permitted by applicable Indian law:
- VoBot's total liability for any claim arising from or related to our services shall not exceed the total amount paid by the client for the specific service giving rise to the claim.
- VoBot shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill.
- We do not guarantee that our services will be uninterrupted, error-free, or free of viruses or other harmful components.
- VoBot is not responsible for any third-party services, APIs, hosting providers, or payment gateways referenced or integrated as part of our deliverables.
9. Governing Law & Dispute Resolution
These Terms are governed by and construed in accordance with the laws of India. Any disputes arising out of or in connection with these Terms or our services shall be resolved as follows:
- Amicable Resolution: The parties shall first attempt to resolve disputes through good-faith negotiation within 30 days of written notice.
- Mediation: If negotiation fails, the dispute shall be referred to mediation under the Mediation Act, 2023.
- Arbitration: If mediation is unsuccessful, the dispute shall be referred to binding arbitration in accordance with the Arbitration and Conciliation Act, 1996, with the seat of arbitration in India.
- Jurisdiction: The courts of competent jurisdiction in India shall have exclusive jurisdiction over any matters not subject to arbitration.
10. Termination
Either party may terminate an ongoing service engagement by providing written notice:
- By User: You may cancel an order subject to our Refunds & Cancellation Policy.
- By VoBot: We may terminate or suspend services if the client breaches these Terms, fails to make payments on time, or engages in conduct detrimental to our business or reputation.
- Upon termination, any outstanding payments for work completed become immediately due.
11. Modifications to Terms
VoBot reserves the right to modify these Terms at any time. Changes will be posted on this page with an updated "Last updated" date. Continued use of our services after changes are posted constitutes acceptance of the revised Terms. For material changes, we will make reasonable efforts to notify registered users via email or platform notification.
12. Miscellaneous
- Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
- Entire Agreement: These Terms, together with our Privacy Policy, Refund Policy, and any service-specific agreements, constitute the entire agreement between you and VoBot.
- Waiver: Failure to enforce any provision of these Terms shall not constitute a waiver of that provision.
- Assignment: You may not assign or transfer your rights under these Terms without our prior written consent.
